You and Watstrending agree that any legal action resulting from or connected to the Services, including Watstrending website/app, must be started within one three-months of the cause of action's accrual; if not, the cause of action will be considered to have expired and no claims may be made regarding it.
12. Resolution of Disputes & Governing Law
Although, Watstrending is operated and controlled from our offices in India but a users from any country may be used to access and operate the website/app, and it may be governed by the laws of that nation. You are in charge of abiding by any applicable local laws if you use the app from any place. * Regarding any legal proceedings that may arise in connection with the Service, including Watstrending website/app, or from a dispute as to the interpretation or breach of the Terms and Conditions, you agree to submit to the jurisdiction of the Gurugram, Haryana courts (without giving effect to their conflicts-of-law principles). * If there is a disagreement or conflict between You and Us (referred to as a "Dispute"), it must first be settled amicably by sincere discussions between You and Us. Any of the parties to the dispute may refer it to arbitration by sending a written notice (referred to as a "Arbitration Notice") for final resolution in compliance with these terms and conditions if a resolution is not reached within 30 (thirty) days of the date the dispute arises, as notified in writing by any party to the other party. * The dispute will be referred to a single arbitrator chosen by both parties upon the issue of an arbitration notice. Any party may refer the case to the President of the SIAC Court of Arbitration in compliance with the Gurugram, Haryana International Arbitration Center's "SIAC Rules" for the appointment of an arbitrator if one is not appointed within thirty (30) days of the Arbitration Notice. The SIAC Rules, which are presumed to be incorporated by reference to this Article, will govern the arbitral proceedings, which will be managed by the Gurugram, Haryana Arbitration Centre. Gurugram, Haryana, will serve as the arbitration's seat. The arbitration will be held in both Hindi and English. * The arbitral tribunal's decision regarding a dispute will be final, binding on the parties, enforceable within its terms, and supported by written documentation. Watstrending and you will submit to the arbitral tribunal's decision, which will be enforceable in any court of law. The expenses of the arbitration process will also be determined by the arbitral panel. Nothing in this agreement will prevent You or Us from requesting interim or injunctive remedies from courts of competent jurisdiction before or during arbitration. * You and Watstrending agree that any cause of action resulting from your use of the app must be filed within three (3) months of the cause of action's accrual or your awareness of the relevant facts, whichever comes first. If not, such a claim will be permanently barred.
13. Notices
Watstrending may post notices on the website or app or send them to the phone number or registered email address you provided as part of your registration data. Within three (3) days of us sending the notice, you will be considered to have received it. Your continuous use of the Website/App on expiry of such 3 (three) days shall constitute.
